We Need to Hold the Supreme Court Accountable

The Supreme Court is the highest court in the land. They hand down decisions that affect the entire country for generations. They should be held to the highest level of ethical conduct.

Except there’s no established code of conduct that these lifetime appointed justices can be held to. Right now, the nine members of the Supreme Court are the only federal judges in the United States that don’t have a code of ethics they’re meant to follow. That’s why it’s difficult to hold Justice Clarence Thomas accountable for failing to recuse himself from cases before the court related to the January 6th insurrection, or Justice Samuel Alito for allegedly leaking how the Court would rule on birth control to wealthy, evangelical anti-abortion activists.

No one is above the law—even the Supreme Court. It’s up to us to demand accountability.

The Supreme Court has an ethics problem.

Despite Ginni Thomas’s attendance at the January 6th rally in D.C. and her clear support for the cause, her husband, Clarence Thomas, failed to recuse himself from Supreme Court cases related to January 6th. On the contrary—he was the only justice to vote against granting the January 6th Select Committee access to key Trump administration documents related to the insurrection.

Recent reporting from the New York Times suggests that Samuel Alito was responsible for leaking how the Court would rule on birth control to wealthy, evangelical anti-abortion activists in 2014. Is it a coincidence that the leaked decision overturning Roe v. Wade was ultimately written by Alito?

This is blatantly unethical. But unlike every other federal judge in the nation, Supreme Court justices aren’t beholden to any structured code of conduct.

As a voter and your constituent, I'm urging you to pass the Supreme Court Ethics, Recusal, and Transparency Act of 2022 ( H.R.7647 / S.4188), which would establish a long overdue code of ethics for the Supreme Court.
